Terms of Service

Article 1 (Scope)

These Terms of Service ("Terms") govern the use of Brambin ("the App") and its associated website ("the Service") provided by KUBOYA Inc. ("the Company"). By using the Service, you agree to these Terms.

Article 2 (Nature of the Service)

The App is an entertainment application that provides cognitive games. It is not a scientifically validated IQ test, psychological assessment, or medical diagnostic tool. All scores, results, and IQ range estimates displayed in the App and on the website are generated for entertainment and educational purposes only. They do not represent a clinical evaluation of intelligence and should not be used as such.

Article 3 (Use of the Service)

No account registration is required to use the App. By downloading and using the App, you agree to these Terms. Certain features may require an in-app purchase to unlock.

Article 4 (In-App Purchases)

The App offers optional in-app purchases. All purchases are processed through Apple App Store or Google Play Store and are subject to their respective terms and refund policies. The Company does not process payments directly. For refund requests, please contact Apple or Google directly through their respective support channels.

Article 5 (Prohibited Activities)

• Violations of laws or public order
• Criminal activity
• Disrupting server or network functions
• Infringing intellectual property rights
• Unauthorized access or attempts thereof
• Misrepresenting App results as official or clinical IQ scores
• Reverse engineering, decompiling, or disassembling the App
• Other acts deemed inappropriate by the Company

Article 6 (Service Suspension)

The Company may suspend the Service without prior notice for maintenance, system failure, or force majeure.

Article 7 (Disclaimer)

The Company does not guarantee the accuracy, completeness, or usefulness of any scores or results provided by the Service. Results are not a substitute for professional psychological evaluation. The Company is not liable for any damages arising from the use of the Service or reliance on its results, except in cases of willful misconduct or gross negligence. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence.

Article 8 (Age Requirement)

The Service is intended for users aged 13 and above (or 16 in the EEA/UK, 14 in South Korea and China, or 18 in India, as applicable under local law). Users who are minors under their local law should use the Service with parental or guardian consent.

Article 9 (Intellectual Property)

All content, designs, and intellectual property within the Service belong to the Company. Unauthorized reproduction, modification, or distribution is prohibited.

Article 10 (Changes to Terms)

The Company may update these Terms at any time. Continued use after changes constitutes acceptance of the updated Terms.

Article 11 (Governing Law)

These Terms are governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court.
